Deleted chats, kept
A federal court order to OpenAI, May 2025
In the New York Times copyright case, a judge ordered OpenAI to preserve ChatGPT output logs it would otherwise delete — including chats users had deleted. The blanket hold ended that September, but what was captured — except logs from the EEA, Switzerland, and the UK — stays held for the litigation. A court can order a chatbot company to keep everything. No court can make your box phone home.

In the same case, a federal judge affirmed an order for OpenAI to produce 20 million de-identified consumer ChatGPT conversations — full prompts and full answers — to the publishers suing it. De-identified and under a protective order, but real people's conversations, pulled into a lawsuit they were never part of.

ChatGPT's "Improve the model for everyone" setting
On consumer ChatGPT accounts, your conversations may be used to train OpenAI's models unless you find the setting and turn it off. Opting out only works going forward — data already used in training doesn't come back out. Your box has no such setting, because it has no such pipe.

Chat histories found sitting open on the internet
In January 2025, security researchers found DeepSeek had left a database publicly reachable with no password — over a million lines of logs, including users' chat histories and API secrets. Every cloud chat lives in someone's server logs, and one misconfiguration is all it takes.
